The purpose of EPR is to make <strong>manufacturers responsible<\/strong> for the disposal and recycling of products after they have reached their useful life.<\/p>\n<p>The idea is that manufacturers have an incentive to produce more <strong>environmentally friendly and recyclable products<\/strong>, since they are responsible for disposing of the products and therefore have to bear the <strong>cost<\/strong> of disposal.<\/p>\n<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-2673\" class=\"elementor-tab-title\" data-tab=\"3\" role=\"button\" aria-controls=\"elementor-tab-content-2673\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon elementor-accordion-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-closed\"><i class=\"fas fa-plus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-opened\"><i class=\"fas fa-minus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">What are the obligations under the EPR?<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-2673\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"3\" role=\"region\" aria-labelledby=\"elementor-tab-title-2673\"><p>The various requirements oblige you to<\/p>\n<ul>\n<li><b>Registration<\/b> with the national competent authorities. Only then are you allowed to import a product into the country.<\/li>\n<li><b>Payment of disposal fees depending<\/b> on the quantity you export to the respective country. For this purpose, a <b>quantity reportis<\/b> required in advance.<\/li>\n<li><b>Labeling and information requirements<\/b> on packaging to inform end users how to maximize recycling, and minimize environmental damage.<\/li>\n<\/ul>\n<p>As there is no central authority within the EU, you must carry out EPR registration separately in each area and for each member state. If you are a direct seller without a branch in the country of destination, you will usually need an authorized local representative, who is liable for you, administers the contracts with take-back systems and communicates with the offices in the respective national language.<\/p>\n<p>Obligations <strong>specifically in Germany are<\/strong> &#8211; depending on the product &#8211; for example the registration with the foundation <a href=\"https:\/\/www.certify-gmbh.de\/en\/service\/ear-registration\/\">EAR (Elektro-Altger\u00e4te-Register)<\/a> as well as the registration with the <a href=\"https:\/\/www.certify-gmbh.de\/en\/service\/lucid-registration\/\">packaging register LUCID<\/a> plus the <strong>participation<\/strong> in a dual system.<\/p>\n<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-2674\" class=\"elementor-tab-title\" data-tab=\"4\" role=\"button\" aria-controls=\"elementor-tab-content-2674\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon elementor-accordion-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-closed\"><i class=\"fas fa-plus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-opened\"><i class=\"fas fa-minus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">When am I obliged?<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-2674\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"4\" role=\"region\" aria-labelledby=\"elementor-tab-title-2674\"><p>If you place goods on the market for sale in the European Union, you must deal with EPR.<\/p>\n<p>You should check your EPR obligations if you<\/p>\n<ul>\n<li>\u2026 <b>manufacture<\/b> products<\/li>\n<li>\u2026 <b>import<\/b> products<\/li>\n<li>\u2026 are an <b>(online) retailer<\/b> and sell products<\/li>\n<\/ul>\n<p class=\"western\">A prerequisite for the obligations is that the respective country <b>does not exclude<\/b> your participation in the registration. Such an exclusion is now only applicable in very few cases, but for example in <b>Italy<\/b>, in the area of packaging, as you need to have a branch there for financial reasons in order to meet the statutory requirements for participation in packaging take-back. Similar exceptions also exist for distributors of batteries. <span style=\"color: #000000;\">Similar exceptions also exist for distributors of batteries. However, they are to be completely eliminated with a long-term perspective in mind.<\/span><\/p>\n<p class=\"western\">There are no exceptions in the area of electrical appliances. In principle, you are therefore obliged to do so <b>in every country<\/b> to which you distribute.<\/p>\n<p class=\"western\">In the area of <b>packaging materials<\/b>, there are also <b>&#8220;de minimis limits&#8221;<\/b> (minimum thresholds) in a few countries. These state that registration only <span style=\"color: #000000;\">becomes a requirement<\/span> from a certain sales volume in Kilos or turnover in Euros <span style=\"color: #000000;\">per year. What does it mean?<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-2676\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"6\" role=\"region\" aria-labelledby=\"elementor-tab-title-2676\"><p class=\"western\">A <b>distributor<\/b> is any legal or natural person who makes products available on a market for the first time with the <b>intention of distributing<\/b> them to consumers. Consumers in this case are both professional end users and private consumers. &#8220;Making available&#8221; includes any provision of a product for <b>distribution, consumption or use<\/b> in the course of a business activity, whether in return for payment or free of charge. <b>Offering a product<\/b> (in an online store or in other ways) is therefore already included.<\/p>\n<p class=\"western\">In other words: If you want to advertise a product, you must already provide proof of registration. <b>Until the registration is successful, a sales ban applies by law.<\/b> If you do not want to advertise your products in a certain country, you would not be legally allowed to operate an online store or offer in the language of that country, or you would have to explicitly exclude the shipment of products to that country.<\/p>\n<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t\t\t<div class=\"elementor-accordion-item\">\n\t\t\t\t\t<div id=\"elementor-tab-title-2677\" class=\"elementor-tab-title\" data-tab=\"7\" role=\"button\" aria-controls=\"elementor-tab-content-2677\" aria-expanded=\"false\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon elementor-accordion-icon-left\" aria-hidden=\"true\">\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-closed\"><i class=\"fas fa-plus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t<span class=\"elementor-accordion-icon-opened\"><i class=\"fas fa-minus\"><\/i><\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t\t\t<\/span>\n\t\t\t\t\t\t\t\t\t\t\t\t<a class=\"elementor-accordion-title\" tabindex=\"0\">Are there penalties if I don't comply with extended producer responsibility?<\/a>\n\t\t\t\t\t<\/div>\n\t\t\t\t\t<div id=\"elementor-tab-content-2677\" class=\"elementor-tab-content elementor-clearfix\" data-tab=\"7\" role=\"region\" aria-labelledby=\"elementor-tab-title-2677\"><p class=\"western\">Yes, there are. The <b>penalties<\/b> are set by law in each country and can <b>vary depending<\/b> on the violation. The penalties are:<\/p>\n<ul>\n<li>if you are not registered<\/li>\n<li><span style=\"color: #000000;\">if you do not submit correct, complete or timely reports<\/span><\/li>\n<li><span style=\"color: #000000;\">if you do not pay disposal fees or charges correctly, completely or on time<\/span><\/li>\n<li>or if you violate the labeling and information requirements<\/li>\n<\/ul>\n<p class=\"western\">Penalties are calculated depending on the severity of the violation and the magnitude of the damage. The usual penalties range from <b>\u20ac1,000 to \u20ac10,000<\/b> per violation. This also means that if two products are not reported, a penalty can be as high as <b>2 x 10,000 \u20ac<\/b>.
