class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>More and more consumers are striving to reduce their ecological footprint.<br \/>\nThis change in mindset has led to environmentally friendly products becoming increasingly popular and the market for <strong>supposedly environmentally friendly products<\/strong> is growing rapidly. <\/p>\n<p>Companies are using this as an opportunity and are increasingly advertising their products with terms such as &#8220;climate neutral&#8221;, &#8220;environmentally friendly&#8221; and the like.<br \/>\nHowever, many of these advertising claims and labels do not stand up to scrutiny.<br \/>\nAccording to an EU study conducted in 2020, 53.3% of environmental claims were vague, misleading or unsubstantiated and 40% of claims could not be substantiated.<br \/>\nThe study also found that for the majority of the claims examined, it was unclear whether the claims related to individual components or the entire product, or whether the claim could be applied to the entire company.<br \/>\nIt was also often not possible to determine which phase of the product life cycle the statement referred to.<br \/>\nFor this reason, the EU wants to use the Green Claims Directive to <strong>take stronger action against misleading and unfounded environmental claims (so-called greenwashing)<\/strong> and create a uniform set of rules in order to provide consumers with more transparency and combat unfair competition.     <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-a1f5910 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"a1f5910\" data-element_type=\"section\" apply?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-9060737 elementor-widget elementor-widget-text-editor\" data-id=\"9060737\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The proposal for the EU directive was adopted by the European Parliament in March 2024, the EU Environment Council&#8217;s assessment took place on June 17, 2024.<br \/>\nThe <strong>final version<\/strong> of the Green Claims Directive is expected to be finalized in a few months based on the two positions. <\/p>\n<p>Implementation in the member states is to take place by March 27 <strong>,<\/strong> 2026 and apply <strong>from September 27, 2026<\/strong>.<br \/>\nIn Germany, the directive will be implemented within the UWG (Act against Unfair Competition). <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-edb0918 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"edb0918\" data-element_type=\"section\" Green Claims Directive?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-4c6a199 elementor-widget elementor-widget-text-editor\" data-id=\"4c6a199\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>In principle, all natural and legal persons who sell products or provide services within the EU that are advertised as environmentally friendly, ecological, sustainable or similar are affected by the directive.<br \/>\nThe directive covers <strong>all sectors and company sizes<\/strong>, but the various countries are to take measures to support <strong>SMEs<\/strong> in implementing the directive, e.g. financially, organizationally or through training.<br \/>\nIn addition, <strong>micro-enterprises <\/strong>are to be given <strong>more time <\/strong>: Companies with fewer than 10 employees and an annual turnover of \u20ac2 million are expected to be given an extra 14 months to comply.  <\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d1808ac elementor-widget elementor-widget-text-editor\" data-id=\"d1808ac\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Companies that advertise with green labels, slogans etc. will therefore be subject <strong>to new obligations in any case<\/strong>.<br \/>\nBelow we have compiled information on what companies can expect.<br \/>\nAs the final version of the directive has not yet been adopted, <strong>changes can still be expected<\/strong>.  <\/p>\n<p>The following lists of requirements are based on the <a href=\"https:\/\/eur-lex.europa.eu\/legal-content\/DE\/TXT\/HTML\/?uri=CELEX:52023PC0166\"><u>first draft of the directive (03\/2023)<\/u><\/a>.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-ecff1fd elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"ecff1fd\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-cbb059c\" data-id=\"cbb059c\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">What are the requirements for explicit environmental statements?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-d44d94a elementor-widget elementor-widget-text-editor\" data-id=\"d44d94a\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>According to the directive, European member states must ensure that companies carry out an assessment that substantiates the <strong>accuracy of the environmental claim<\/strong>.<br \/>\nAt the moment, it is still unclear which authority is responsible for assessing the environmental claims.<br \/>\nThis assessment requires, among other things:  <\/p>\n<ol>\n<li>It must be made clear whether the <strong>environmental claim relates to the entire product, part of the product or only to certain aspects <\/strong>of the product.<br \/>\nIt must also be made clear whether the statement refers to the <strong>company<\/strong> as a whole or only to parts of the company. <\/li>\n<\/ol>\n<p><strong>Example:<\/strong> A company advertises that it uses 10% less water through new measures, but conceals the fact that this only applies to the production process of a single product.<\/p>\n<ol start=\"2\">\n<li>The environmental claim must be assessed according to generally <strong>accepted scientific knowledge<\/strong>, accurate information and relevant <strong>international standards<\/strong>.<\/li>\n<li>The assessment shall demonstrate that the positive characteristics highlighted in the environmental claim are <strong>relevant<\/strong> during the life cycle of the product.<\/li>\n<li>It must be demonstrated that the environmental statement <strong>does not only refer to legal minimum standards<\/strong> that apply to a product or industry and must not present this as something special.<\/li>\n<li>When making statements on environmental performance, the assessment must take into account <strong>all aspects and impacts<\/strong> that are decisive for the assessment of environmental performance.<\/li>\n<li>The assessment must take into account whether the <strong>improvement of<\/strong> environmental characteristics in one area leads to a significant <strong>deterioration<\/strong> of environmental characteristics in another area.<\/li>\n<\/ol>\n<p><strong>Example<\/strong><strong>:<\/strong> A product is made more durable and reusable by changing the materials, but is also much more difficult to recycle.<\/p>\n<ol start=\"7\">\n<li><strong>In<\/strong> particular, it must be <strong>clear<\/strong> whether the compensation payment relates to the reduction of greenhouse gas emissions or to the removal of greenhouse gases from the atmosphere.<\/li>\n<\/ol>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-fcda4a2 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"fcda4a2\" data-element_type=\"section\" data-e-type=\"section\">\n\t\t\t\t\t\t<div class=\"elementor-container elementor-column-gap-default\">\n\t\t\t\t\t<div class=\"elementor-column elementor-col-100 elementor-top-column elementor-element elementor-element-c5b55c0\" data-id=\"c5b55c0\" data-element_type=\"column\" data-e-type=\"column\">\n\t\t\t<div class=\"elementor-widget-wrap elementor-element-populated\">\n\t\t\t\t\t\t<div class=\"elementor-element elementor-element-53bc43e elementor-widget elementor-widget-heading\" data-id=\"53bc43e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"heading.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t<h2 class=\"elementor-heading-title elementor-size-default\">What are the requirements for comparative environmental statements?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-5e1190e elementor-widget elementor-widget-text-editor\" data-id=\"5e1190e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>The Directive also provides further assessment bases for comparative environmental claims.<br \/>\nComparative environmental claims either claim or imply that a product or company achieves a <strong>better environmental performance<\/strong> or produces <strong>less negative environmental impacts<\/strong> than competitors or competing products.<br \/>\nAmong other things, this is required:  <\/p>\n<ol>\n<li>The assessment of the environmental aspects, environmental performance and environmental impacts of a product or company shall be based on the <strong>same information<\/strong> as that used in the assessment of the compared product or company.<\/li>\n<li>The data used for the evaluation must be <strong>collected in the same way<\/strong> as the data of the compared product or company.<\/li>\n<li>The <strong>stages along the value chains<\/strong> are taken into account in the same way, and in particular it is ensured that the most important stages are included.<\/li>\n<li>The consideration of environmental aspects, environmental performance and environmental impacts must be based <strong>on<\/strong> the <strong>same standards<\/strong> for the comparative product or the comparative company.<\/li>\n<li>If the <strong>comparison<\/strong> is made <strong>on the basis of a<\/strong> <strong>predecessor product<\/strong>, the justification of the environmental claim must explain the following: How does the improvement affect other relevant environmental impacts, environmental aspects or environmental performance of the product to which the claim relates?<br \/>\nThe reference year on which the comparison is based must also be stated. <\/li>\n<\/ol>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-1b480c4 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"1b480c4\" data-element_type=\"section\" elementor-size-default\">Re-examination<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-eee296e elementor-widget elementor-widget-text-editor\" data-id=\"eee296e\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>Furthermore, the company is required to carry out the assessment again if either material aspects of the <strong>assessment basis<\/strong> have <strong>changed<\/strong> or the original statement and the information provided are already <strong>5 years old <\/strong>.<\/p>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-1b26772 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" companies communicate environmental statements?<\/h2>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<div class=\"elementor-element elementor-element-fe73fde elementor-widget elementor-widget-text-editor\" data-id=\"fe73fde\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<p>In principle, companies may only communicate environmental claims that are <strong>classified as significant<\/strong> for the product or company in question.<br \/>\nIf the claim refers to an end product, the statement must contain information on how the consumer should use the product in order to achieve the expected environmental performance.<br \/>\nIf an environmental claim refers to the environmental performance of a product or a company in the future, it must include a <strong>time-bound commitment for improvements<\/strong> in the company&#8217;s own activities and within the value chains.<br \/>\nIn addition, <strong>information<\/strong> about the product or company about which the environmental claim is made and the <strong>justification<\/strong> for the environmental claim must <strong>be provided<\/strong> together either in physical form or in the form of a website, QR code or similar form.<br \/>\nThe information must include at least    <\/p>\n<ol>\n<li>The <strong>environmental aspects, environmental impacts or environmental performance<\/strong> that are the subject of the statement.<\/li>\n<li>The relevant Union standards or the relevant international <strong>standards<\/strong>.<\/li>\n<li>The <strong>underlying studies or calculations<\/strong> used for the valuation, unless they are trade secrets.<\/li>\n<li>A brief explanation of <strong>how the improvement is achieved<\/strong><\/li>\n<li>The <strong>certificate of conformity<\/strong> and the contact details of the relevant inspection body.<\/li>\n<li>If available, the amount of <strong>greenhouse gas offsets<\/strong> and whether these offsets were used to reduce greenhouse gas emissions or to remove greenhouse gases from the atmosphere.<\/li>\n<li>A <strong>clear and comprehensible summary<\/strong> of the assessment and the previous points in at least one of the official languages of the Member State in which the environmental claim is advertised.<\/li>\n<\/ol>\n\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t<\/section>\n\t\t\t\t<section class=\"elementor-section elementor-top-section elementor-element elementor-element-b5477f7 elementor-section-boxed elementor-section-height-default elementor-section-height-default\" data-id=\"b5477f7\"
